These Terms and Conditions (the “Terms”) apply to the use of the websites lovejolly.eu and lovejolly.XX (where “XX” refers to any European Union or European Economic Area country code top-level domain operated by Pixta Commerce OÜ), as well as to all sales of goods made through such websites.

1. Scope and Application

1.1. These Terms govern the relationship between Pixta Commerce and any natural person purchasing goods for purposes outside their trade, business, craft or profession (“consumer”, “you”, or “your”).
1.2. We sell exclusively to customers located within the European Union (EU) and the European Economic Area (EEA).
1.3. These Terms are drafted in English. Where translations are provided for convenience, the English version shall prevail in the event of any inconsistency.

2. Age of Consent

2.1. You must be at least 18 years of age to purchase sex toys, erotic devices, and related non-consumable products.
2.2. Consumables for sexual health and well-being, such as condoms and lubricants, may be purchased by persons under the age of 18.
2.3. By placing an order, you confirm that you meet the applicable age requirement. We reserve the right to cancel any order if we reasonably believe this requirement has not been met.

3. Ordering and Contract Formation

3.1. All orders placed through the Website are subject to acceptance and availability.
3.2. A contract between you and Pixta Commerce is formed only upon dispatch confirmation sent by us by email.
3.3. We reserve the right to cancel any order before dispatch if:
(a) the product is not available or incorrectly listed as in stock;
(b) your payment cannot be processed;
(c) we reasonably suspect fraud or misuse; or
(d) you have not complied with these Terms.

4. Prices and Payment

4.1. All prices displayed on the Website are in euros (€) and include Estonian VAT at the rate of 22% (unless otherwise stated).
4.2. We accept payment by Visa, MasterCard, PayPal, and bank transfer.
4.3. Payment must be made in full at the time of order.

5. Shipping and Delivery

5.1. Orders are dispatched from our warehouses located in Estonia or Spain.
5.2. We ship via DPD, UPS, DHL and other contracted carriers, using ground or air methods as selected during checkout.
5.3. Delivery options and estimated timeframes are displayed during checkout based on destination country and postal code. Deliveries are generally completed within seven (7) business days, subject to courier availability and national holidays in Estonia and Spain.
5.4. All orders are shipped in plain, discreet packaging, with sender details shown as “Pixta Commerce OÜ”, “PC Logistic” or “Pixta Commerce Logistic.”
5.5. Risk of loss and title to the goods pass to you upon delivery.

6. Right of Withdrawal and Returns

6.1. Consumers in the EU/EEA have a statutory right to withdraw from a contract within 14 days of receiving the goods, without giving any reason.
6.2. In addition, Pixta Commerce offers a voluntary 365-day return policy (“Extended Return Policy”).
6.3. The right of withdrawal and Extended Return Policy do not apply to goods which are sealed for health or hygiene reasons (including but not limited to sex toys, lingerie, lubricants, and cosmetics) once unsealed after delivery.
6.4. If you wish to exercise your right of withdrawal or the Extended Return Policy, you must first contact our customer service. Returns must be sent to:

6.5. Unless the item is defective, you bear the direct cost of returning the goods.
6.6. Refunds will be made using the same payment method as originally used, unless otherwise agreed. In certain cases, we may offer store credit as an alternative.

7. Warranty and Defective Goods

7.1. All goods are covered by the statutory 2-year warranty under EU law.
7.2. Consumables, batteries, and other perishable items are subject to a shorter warranty, limited to their normal shelf life.
7.3. If a product is defective, you are entitled to request repair, replacement, or, where applicable, a refund in accordance with EU consumer law.

8. Limitation of Liability

8.1. We are not liable for any:
(a) losses not foreseeable at the time of contract;
(b) business losses or use of goods for non-personal purposes;
(c) indirect or consequential damages.
8.2. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any matter where liability cannot be excluded under law.

9. Force Majeure

We shall not be liable for failure to perform or delay in performing our obligations under a contract where such failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, epidemics, pandemics, war, or governmental restrictions.

10. Intellectual Property

All text, graphics, logos, product images, and content on the Website are the property of Pixta Commerce or its licensors. You may not copy, reproduce, or use such material except for personal, non-commercial purposes.

11.1. We process personal data in accordance with applicable Estonian and EU data protection laws.

13.2. Any disputes arising under these Terms shall be subject to the jurisdiction of the Harju County Court (Harju Maakohus), Tallinn, Estonia. Consumers resident in the EU/EEA may also bring proceedings in their home country under applicable EU law.
